Terms of Service - JOHN DRAGON

1. General Provisions

These Terms of Service ("Terms") define the rules for using the John Dragon website available at https://johndragon.pl ("Website"), which enables booking cruises on the John Dragon motorboat through our online booking system.

The owner and operator of the Website is GPI PROJEKT Prosta Spółka Akcyjna, headquartered in Warsaw (05-077), ul. Cyklamenowa 7, registered in the National Court Register under KRS number [to be completed], NIP 9522229976, REGON [to be completed], e-mail: [email protected] ("Operator").

The Operator provides cruise organization services on the John Dragon motorboat ("Service") in accordance with the terms specified in these Terms.

The User ("Client") is obliged to familiarize themselves with the content of the Terms before making a reservation. Making a reservation means acceptance of all its provisions.

2. Scope of Services

The Website enables reservation and purchase of tickets for cruises on the John Dragon motorboat on specific routes and at selected dates.

Reservations are made through our online booking system, which handles payments and transmits reservation data to the Operator.

The Service agreement is concluded between the Client and the Operator. The booking system acts as a technical intermediary handling the booking process.

The Operator reserves the right to cancel or change the cruise date in case of:

• unfavorable weather conditions,
• technical failure,
• administrative decisions or navigation restrictions,
• insufficient number of participants.

3. Participation Conditions

A cruise participant may be an adult or a minor under the supervision of an adult.

The Client is obliged to follow the skipper's instructions and observe water safety rules.

Participants under the influence of alcohol or intoxicants will not be allowed on the cruise, without the right to a refund.

The Operator provides rescue equipment in accordance with applicable regulations.

The participant is obliged to appear at the cruise starting point at least 15 minutes before the scheduled departure time. Being late resulting in inability to participate in the cruise is not grounds for a refund.

4. Reservations and Payments

Reservations are made exclusively through our online booking system available on the Website.

Payment for the cruise is made in advance, in the payment system operated by our payment provider.

Prices are quoted in Polish zlotys (PLN) and include VAT.

Booking confirmation constitutes proof of conclusion of an agreement between the Client and the Operator.

In case of cruise cancellation by the Operator, the Client is entitled to a full refund of the paid amount or the possibility to change the date.

In case of Client cancellation:

• up to 48 hours before the planned cruise – 100% refund,
• less than 48 hours – no refund.

5. Liability

The Operator is not liable for events resulting from force majeure, administrative authority decisions, sudden weather changes, or participant behavior inconsistent with safety rules.

The Operator is not responsible for damages resulting from failure to follow crew instructions or cruise regulations.

Participants are materially liable for damages caused by their fault to the Operator's property.

The Operator is not liable for loss or destruction of participants' personal belongings during the cruise.

6. Personal Data

The personal data controller of Clients is GPI PROJEKT PSA.

Personal data is processed for the purpose of handling reservations, fulfilling the contract, contacting the Client, and potentially handling complaints.

Detailed data processing rules are specified in the Privacy Policy available on the Website.

Payment data is processed by our payment provider in accordance with its terms and privacy policy.

7. Complaints

Complaints regarding the Service should be submitted by email to: [email protected] within 7 days from the cruise date.

The complaint should include the Client's data, cruise date, and event description.

The Operator will consider the complaint within 14 days of receipt and inform the Client of the proceedings outcome.

8. Final Provisions

Matters not regulated by these Terms shall be governed by the provisions of the Civil Code and other applicable Polish law.

The Operator reserves the right to change the Terms. Changes take effect from the date of their publication on the Website.

All disputes arising from the agreement between the Client and the Operator will be settled by the court competent for the Operator's registered office.

The Terms are effective from the date of publication on the Website.
